Terms of Service

Please read these terms carefully before using our courier and logistics services.

1. Acceptance of Terms

By accessing or using the services provided by Trueship International Courier Service ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access our services.

These Terms constitute a legally binding agreement between you and Trueship International Courier Service regarding your use of our courier, logistics, and related services.

We reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.

2. Definitions

For the purposes of these Terms, the following definitions apply:

"Shipment"

Any package, parcel, document, or cargo tendered to us for transportation.

"Consignor"

The person or entity who sends the shipment (also called "Shipper").

"Consignee"

The person or entity who is intended to receive the shipment.

"Services"

All courier, logistics, transportation, and related services provided by us.

"Prohibited Items"

Items that cannot be shipped under these Terms or applicable law.

"Declared Value"

The value declared by the Consignor for customs or insurance purposes.

3. Our Services

Trueship International Courier Service provides the following logistics and courier services:

3.1 Service Offerings

  • Domestic Courier: Within-country parcel and document delivery
  • International Shipping: Cross-border logistics and customs clearance
  • Express Delivery: Time-critical and same-day delivery services
  • Bulk Shipping: Commercial cargo and freight forwarding
  • Warehousing: Storage and inventory management solutions
  • Value-Added Services: Packaging, insurance, COD (Cash on Delivery)

3.2 Service Limitations

We reserve the right to refuse service to any shipment or individual at our discretion, including but not limited to situations involving prohibited items, insufficient documentation, or security concerns.

4. Shipment Terms

4.1 Packaging Requirements

All shipments must be properly packaged to protect contents during transportation. We reserve the right to reject shipments with inadequate packaging. For international shipments, packaging must comply with IATA (International Air Transport Association) regulations.

4.2 Labeling and Documentation

  • Complete and accurate sender and recipient information
  • Valid contact numbers for both parties
  • Detailed description of contents for customs purposes
  • Accurate declared value
  • Any required permits, licenses, or certificates

4.3 Inspection Rights

We reserve the right to open and inspect any shipment to verify contents, ensure compliance with laws, and confirm proper documentation. This includes inspections by customs authorities for international shipments.

4.4 Delivery Attempts

We will attempt delivery as specified in the service agreement. If delivery cannot be completed due to:

  • Incorrect or incomplete address
  • Recipient unavailable after multiple attempts
  • Refusal to accept by recipient
  • Customs clearance delays or issues

The shipment may be returned to sender or held at our facility, subject to additional storage fees.

5. Prohibited and Restricted Items

IMPORTANT NOTICE

Attempting to ship prohibited items may result in seizure of goods, legal penalties, fines, and permanent suspension of your account. You may also be liable for damages caused by such shipments.

5.1 Absolutely Prohibited Items

Explosives, firearms, and ammunition
Illegal drugs and narcotics
Hazardous chemicals and toxic substances
Counterfeit goods and currency
Human remains and ashes
Live animals (except as permitted)
Perishable foods without proper packaging
Pornographic and obscene materials
Gambling devices and lottery tickets
Precious metals and jewelry (uninsured)

5.2 Restricted Items (Require Special Approval)

  • Alcoholic beverages
  • Tobacco products
  • Pharmaceuticals and medicines
  • Batteries and electronic devices with lithium batteries
  • Magnetic materials
  • Aerosols and pressurized containers

6. Pricing and Payment

6.1 Pricing Structure

Our pricing is based on:

  • Weight and dimensions of the shipment
  • Origin and destination locations
  • Selected service type (Standard, Express, etc.)
  • Additional services (insurance, COD, etc.)
  • Fuel surcharges and applicable taxes
  • Customs duties and clearance fees (for international)

6.2 Payment Terms

  • Full payment required before shipment dispatch
  • Accepted payment methods: Credit/Debit cards, UPI, Net Banking, Cash
  • Outstanding payments may result in shipment hold
  • Prices subject to change without prior notice

6.3 Additional Charges

Additional fees may apply for:

  • Address correction during transit
  • Re-delivery attempts
  • Storage fees for undelivered shipments
  • Return to sender requests
  • Special handling requirements
  • Customs duties and taxes (DDU/DDP shipments)

7. Liability and Insurance

7.1 Standard Liability

Our liability for loss or damage is limited as follows:

  • Domestic Shipments: Limited to the lower of (a) actual loss or (b) ₹100 per kg of gross weight
  • International Shipments: Limited per applicable international conventions (Warsaw/Montreal Convention)
  • Documents: Limited to replacement cost only, excluding consequential damages

We are NOT liable for: (a) indirect, consequential, or special damages; (b) loss of profits, revenue, or business opportunities; (c) delay in delivery unless caused by gross negligence.

7.2 Declared Value and Insurance

For higher protection, you may:

  • Declare a higher value for your shipment (up to specified limits)
  • Purchase additional insurance coverage
  • Provide proof of value for claims (invoices, receipts)

Insurance coverage is subject to additional premium payment and specific terms and conditions of our insurance partners.

7.3 Exclusions from Liability

We are not liable for loss or damage arising from:

  • Acts of God (natural disasters, weather events)
  • War, terrorism, riots, or civil unrest
  • Acts or omissions of customs or government authorities
  • Inherent defect or nature of the goods
  • Insufficient or improper packaging by sender
  • Delay in delivery due to incorrect address or recipient unavailability

8. Claims and Refunds

8.1 Filing a Claim

To file a claim for loss or damage:

  1. Notify us in writing within 48 hours of delivery (for damage) or expected delivery date (for loss)
  2. Provide original invoice, tracking number, and photos of damage (if applicable)
  3. Submit claim form with all supporting documentation
  4. Allow us reasonable time to investigate (up to 30 days)

TIME LIMIT: No claims will be accepted after 30 days from the date of shipment for domestic, or 60 days for international shipments.

8.2 Refund Policy

Refunds may be granted in the following situations:

  • Service failure due to our error (exclusions apply)
  • Overcharging or billing errors
  • Cancellation before shipment dispatch (subject to cancellation fees)

Refunds will be processed within 7-14 business days to the original payment method.

9. User Obligations

By using our services, you agree to:

Accurate Information

Provide true, accurate, and complete information for all shipments

Legal Compliance

Ensure shipments comply with all applicable laws and regulations

Proper Packaging

Package items adequately to prevent damage during transit

Payment

Pay all charges promptly and maintain valid payment information

You are solely responsible for ensuring that your shipments do not contain prohibited items and that all customs documentation is accurate and complete.

10. Termination and Suspension

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Attempting to ship prohibited items
  • Fraudulent activities or misrepresentation
  • Non-payment of outstanding charges
  • Abusive behavior towards our staff
  • Activities that may harm our reputation or operations

Upon termination, your right to use our services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

11.2 Dispute Resolution

Before initiating any legal action, you agree to:

  1. Contact our customer service to attempt resolution
  2. Allow us 30 days to respond and attempt resolution
  3. If unresolved, parties may opt for mediation
  4. If mediation fails, parties may pursue arbitration or litigation

We encourage amicable resolution of disputes. Our customer service team is empowered to resolve most issues quickly and fairly.
